Guidelines governing your use of this website, charitable donations, membership, and volunteer participation with the Ershad Julekha Foundation.

1. Acceptance of Terms

By accessing, browsing, or utilizing the website of the Ershad Julekha Foundation ("EJ Foundation", "we", "us", or "our") at ejfoundation.org.nz, or by submitting donations, membership forms, or volunteer applications, you agree to be legally bound by these Terms of Use and Donation Policy.

If you do not agree with any part of these terms, please do not use our website or services.

2. Charitable Objectives & Non-Distribution Constraint

The Ershad Julekha Foundation is an incorporated charitable trust registered under the Charities Act 2005 (Registration CC63864). All operations, programs, and disbursements are governed strictly by our registered Trust Deed.

  • Zero Private Dividends: In accordance with our statutory non-distribution constraint, no trustee, board member, or officer receives private dividends or pecuniary profits.
  • 100% Public Benefit: All funds received are applied exclusively toward advancing youth skills education, academic literacy grants, and humanitarian relief in New Zealand and partner communities.

3. Charitable Donations Policy

3.1 Voluntary Nature of Contributions

All donations made to the EJ Foundation—whether via our online payment gateway, direct bank transfer, or postal check—are voluntary, irrevocable charitable contributions made for public benefit.

3.2 Official Donation Receipts

The Foundation issues official charitable donation receipts for all contributions. Online donors will receive an automated electronic receipt via email, while bank deposit donors can request an official receipt by submitting their transaction reference through our Receipt Portal.

3.3 Fund Allocation & Stewardship

Donors may select specific program allocations (Youth Skill Labs, Education Support, Humanitarian Aid, or General Fund). While the Foundation endeavors to apply funds according to donor preferences, the Board of Trustees reserves final fiduciary discretion to allocate funds where they are most urgently needed to fulfill our charitable purposes.

3.4 Refund Policy

Because donations are charitable gifts used immediately to support community initiatives, donations are generally non-refundable. However, the Foundation will consider refund requests in exceptional circumstances (e.g., technical duplicate charge, demonstrably unauthorized transaction, or an accidental data entry error).

Refund requests must be submitted in writing within 14 calendar days of the transaction date to chairperson@ejfoundation.org.nz along with proof of payment. Approved refunds will be processed via the original payment method.

4. Membership & Volunteer Application Conduct

When submitting applications for Foundation Membership or Volunteer Engagement:

  • You warrant that all information provided is true, accurate, current, and complete.
  • You agree to uphold the dignity, safety, and ethical reputation of the Foundation and its beneficiaries.
  • Volunteers working with youth or vulnerable individuals agree to comply with our safeguarding guidelines and relevant background vetting procedures.
  • The Board of Directors reserves the right to accept, decline, or revoke membership or volunteer status in accordance with our governance bylaws.

5. Intellectual Property & Fair Use

All content on this website—including text, editorial publications, graphics, logos, icons, images, audio clips, digital downloads, and layout designs—is the property of the Ershad Julekha Foundation and is protected by New Zealand and international copyright laws.

You may view, download, and print pages for personal, non-commercial, and educational purposes provided you do not remove any copyright notices or alter the content.

6. Disclaimer of Warranties & Limitation of Liability

This website and all information, materials, and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the maximum extent permitted under New Zealand law, the EJ Foundation, its trustees, and its officers shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use this website.

7. Governing Law & Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
